Cotter Special Council Meeting – March 23, 2023, at 6:00 pm

Notice is hereby given to the public, that the City Council of Cotter shall hold a Special Meeting at 6:00 pm on March 23, 2023, followed by the regular City Council Meeting at Cotter City Hall. A public hearing for comments shall be held for the purpose of discussing proposed Sewer Rate Ordinance 2023-02, to follow Arkansas Rural Water Association’s 2021 rate study recommendations to keep the current sewer rate per thousand without change at this time and adjust the sewer rate annually to “Cover Cost of Services Increases” four percent annually for inflation beginning January 1, 2024. Sewer Rate Study by ARWA

Arkansas Rural Water Association (ARWA) conducted a Sewer Rate Study for year 2021, for the City of Cotter. Attached is the Sewer Rate Study dated November 30, 2022. Recommendation can be found on page seven. ARWA recommendation on page seven state that current sewer rates are adequate, but they recommended adjusting rates annually to “Cover Cost of Service Increases” (3%-5%) for annual inflation. Council will consider recommendations on page seven in the near future. A notice of “public comment” meeting is required before any action can be taken. See Proposed Ordinance 2023-02 – Sewer Rate Annual Cost of Inflation. Current Sewer Rates will remain unchanged.

Cotter Water Rate Study by ARWA Per Act 605

In determining water rates, Water Provider (all public water utilities) meaning City of Cotter must use one of Arkansas Natural Resources Division (ANRD) approved rate study providers. Rate study companies must start performing rate studies that conform with ACT 605 of 2021 and the rules adopted by ANRD Commissioners/ Arkansas Department of Agriculture. The results of water rate study for the City of Cotter will state that this rate study was done in accordance with the rules pertaining to ACT 605 of 2021. The City of Cotter contracted with ARWA (Arkansas Rual Water Assocation) to perform a rate study based on year 2021. This rate study was completed November 30, 2022, by ARWA. See attached water rate study for the City of Cotter. The City of Cotter shall comply with the three recommendations found on page 7 of 8 to comply with ACT 605. The City Council will meet on January 26, 2023, to consider passage of Ordinance 2023-01, to increase water rates to be in compliance. The last time the City of Cotter raised water rates was on December 17, 2009.
